About these terms

These Terms of Service apply when you visit wallclixx.com or purchase wallCLIXX™ products from us.

“We”, “us” and “wallCLIXX” mean wallCLIXX Limited:

By placing an order, you agree to these terms. Nothing in these terms excludes or limits any mandatory rights you have under applicable consumer law.

Product information

We take reasonable care to describe and display our products accurately. Colours and appearance may vary slightly because of photography, lighting, screen settings and normal manufacturing variation.

Please review the product description, installation guide, product limitations and surface or fastener requirements before installing wallCLIXX™.

Pricing and payment

Product prices and currencies are displayed on the website or at checkout.

Applicable taxes and shipping charges are shown before you submit your order. Payment must be successfully authorised before an order is dispatched.

If an obvious pricing, product-description or availability error affects an order, we will contact you promptly. We will not charge a different amount without your agreement. If the order cannot proceed, we will cancel it and refund any amount paid.

Orders

Submitting an order is an offer to purchase from us. We accept your order when we send an order-confirmation or dispatch email.

We may reject or cancel an order before dispatch for a legitimate reason, including:

Payment failure
Suspected fraud or unauthorised activity
An obvious pricing or product error
Legal or delivery restrictions
Lack of available stock

If we cancel an order after payment has been received, we will refund the amount paid.

Dispatch and shipping

Orders are dispatched within 48 hours after payment is confirmed. Orders placed on weekends or public holidays may be dispatched on the next working day.

New Zealand orders and orders outside Europe are fulfilled from New Zealand. European orders are fulfilled from France.

Available delivery options and the exact shipping charge are shown at checkout before payment.

Delivery dates and transit times are estimates rather than guaranteed dates. Customs processing, courier disruption, severe weather and other circumstances outside our reasonable control may cause delays.

Where consumer law makes us responsible for delivery, our responsibility for the goods continues until they are delivered to you or to a person you nominated.

Cancellations, returns and refunds

Contact info@wallclixx.com promptly if you wish to cancel an order. Please include your order number.

If your order has already been dispatched, our Returns and Refunds Policy applies.

For eligible consumer orders containing no more than two sets, we offer a voluntary 30-day risk-free trial. If wallCLIXX™ is not right for you, contact us within 30 days after delivery and we will refund the amount paid for the eligible product—even if it has already been fitted.

Products covered by this voluntary 30-day promise do not need to be returned.

Larger orders, wholesale purchases and trade orders are not automatically covered by the voluntary 30-day promise. Contact us and we will discuss the appropriate solution. This does not limit any statutory rights applying to those orders.

Damaged, faulty or incorrect orders

Please inspect your order when it arrives.

If anything is damaged, faulty, incomplete or incorrect, email info@wallclixx.com as soon as reasonably possible. Include your order number and, where possible, a photograph showing the issue.

We will investigate and put it right. Where the product does not meet a statutory consumer guarantee, we will provide the remedy required by applicable law.

Two-year voluntary warranty

wallCLIXX™ products include a two-year voluntary warranty against defects in materials or manufacture, beginning on the delivery date.

If a product fails during normal use because of a covered defect, we will replace it.

The voluntary warranty does not cover damage caused by:

Misuse or abnormal use
Modification or alteration
Incorrect installation
Unsuitable walls, surfaces, fasteners or anchors
Exceeding stated product or load limits
Installation or use contrary to our instructions
Normal wear and tear

This voluntary warranty is additional to your statutory rights. It does not replace or limit those rights, and statutory protection may apply beyond the two-year warranty period.

Installation and use

You must follow the installation guide and select fasteners and anchors suitable for the artwork, frame, wall construction and installation environment.

You are responsible for deciding whether you can install the product safely. If you are uncertain about the wall, fasteners, load or installation method, obtain advice from an appropriately qualified installer.

To the extent permitted by law, we are not responsible for damage caused by misuse, modification, unsuitable fasteners or surfaces, exceeding stated limits, or installation contrary to our instructions.

Nothing in this section excludes responsibility that cannot lawfully be excluded.

Intellectual property

wallCLIXX™ and the wallCLIXX logo are trademarks of wallCLIXX Limited.

The wallCLIXX product is protected by pending patent applications and registered design rights in applicable jurisdictions.

The wallCLIXX name, logo, product designs, website content, photographs, illustrations and installation materials are owned by or licensed to wallCLIXX Limited.

They may not be copied, manufactured, reproduced, modified, distributed or used commercially without our prior written permission, except where permitted by law.

Consumer rights

New Zealand consumer purchases are protected by the Consumer Guarantees Act 1993 and Fair Trading Act 1986.

Consumers in the European Union retain the mandatory consumer rights applying in their country, including applicable withdrawal and product-conformity rights.

EU consumers purchasing online generally have the right to withdraw from a purchase without giving a reason within 14 days after delivery. Our voluntary 30-day risk-free promise provides additional rights for eligible orders and does not replace the statutory EU withdrawal right.

Nothing in these terms excludes, restricts or modifies a right or remedy that cannot legally be excluded, restricted or modified.

Trade and wholesale orders

Trade, wholesale and distributor orders may be subject to a separate written quotation, supply agreement or distributor agreement.

If there is an inconsistency between these terms and a separate written agreement, the separate agreement applies to the extent permitted by law.

Limitation of responsibility

We do not exclude or limit responsibility where doing so would be unlawful.

Subject to your mandatory consumer rights, we are not responsible for loss or damage caused by:

Incorrect installation or use
Failure to follow supplied instructions
Unsuitable walls, frames, fasteners or anchors
Unauthorised alteration of the product
An event outside our reasonable control

Website availability and third-party links

We aim to keep the website accurate, secure and available, but cannot guarantee uninterrupted or error-free access.

Links to third-party websites or services may be provided for convenience. Those websites and services are governed by their own terms and policies, and we are not responsible for their content or availability.

Privacy

Our collection and use of personal information are governed by our Privacy Policy.

By placing an order, you acknowledge that we need to process certain personal information to accept payment, fulfil the order, arrange delivery, provide customer service and meet our legal obligations.

Events outside our reasonable control

We are not responsible for a delay or failure caused by an event outside our reasonable control.

If such an event affects your order, we will take reasonable steps to minimise its effects and keep you informed. Your rights under applicable consumer law remain unaffected.

Changes to these terms

We may update these terms from time to time.

The version displayed when you place an order applies to that order unless a change is required by law or you agree otherwise.

Governing law

These terms are governed by New Zealand law.

Consumers outside New Zealand retain any mandatory protections and rights to bring proceedings that apply under the law of their country of residence.
